We, have in the past seen a number of properties which are owned by the Church being given for re-development.While there may be restrictive clauses in the agreements signed between the Churches and the Developer which restrict the sale of flats only to Roman Catholics the said clauses are never incorporated in toto when agreements are signed between the developer and the flat purchaser.An example of this is in the agreement of Suraj Estate Developers and St.Michaels Church in the case of the Marinagar project where it was mandatory that one particular clause had to re produced in toto in the purchasers agreement but the same was not done. It has also been seen that when co-operative societies’s are formed the said societies members who have themselves taken the benefit of the Roman Catholic clause in the agreements and thus have got the said flat at a below market rate sell/rent/lease the flats to non catholics thereby making profits for themselves and depriving and or forcing the community out of Mumbai. Catholics who feel they have a future in Mumbai should get united and should stop this menace as a time will come when besides the Schools , Churches and graveyards nothing will remain in Mumbai and all catholics will be forced to go beyond Vasai if these modern day Judases are not stopped.
It has also been seen that a number of persons claim that they are catholic when in fact they are not and get the benefit of a flat which is meant exclusively for catholics.
Even after the said fact has been brought to the notice of the higher ups in the Church very little has been done to rectify the same.
Hence ,all future agreements signed with developers where flats are to be sold / resold /leased/occupied/sub let to Roman Catholics clauses should be incorporated wherein all flat sale agreements before and even after formation of the Society should be tripartite agreements where one of the parties is the Church so that it is ensured that flats are sold to Roman Catholics only.The Church can also charge a fee of a certain amount for the Services rendered.Thus it can be ensured that properties which were meant for Roman Cathilics continue to remain for Roman Catholics.
Flats Owned by the Church
All lease agreements signed with parties should be properly documented and various registers should be maintained one copy of which should be with a central office since it has been noticed that when the Parish Priest gets transferred files disappear and 11 month leases get converted to tenancies and the Church gets nothing from the deal. So also when flats are given on rent agreements are drawn up and in most cases the Church has not been paid a single paise as Transfer Premium(Pagri) despite it being legal. So also most flats which are given to people are those persons who are ushers,church workers, or those with the right connections and all those flats have been given at below market rates and thus a person is made rich overnight. It has also been seen that the same families are the beneficiaries of this largesse and the theory put forth is that they are deserving catholics.
My question is that there are 10,000 more deserving families in Dharavi/Jari Mari/Golibar and if Catholics are to be lifted up then flats should be given to such families in Naigaon,Thane district where a greater number of flats can be purchased with the transfer premium obtained and instead of one Rich Family being made richer by giving the flat at below market rates 4 poor families can be lifted up in the same amount and at least they will be faithful to the Church. Flats have been locked up for years and the Church has not done anything.So also residential flats have been made into offices and the Church has chosen to look the other way.Flats/Shops have been sublet for years and persons on the property committee have done nothing and when confronted state that they are not aware of the law.Persons who are supposed to protect church property are the ones who have become most dangerous.
If the Roman Catholic community needs to survive in Mumbai all these issues should be tackled immediately or else a time will come when no property will remain and we will have to blame ourselves.
